October 2012 Twentymile Coal, LLC * Phase 1 Laabzb Release Applecataon • Page 5 <br />3.0 PHASE 1 PARTIAL BOND RELEASE SUMMARY <br />TC has, at this time, completed demolition of the CYCC Office Building, final reclamation of the <br />EMD Ventilation Shaft Installation, final reclamation of the 18 -Right Intake Shaft pad area, and <br />final reclamation of the Fish Creek Tipple Facilities area. The reclaimed areas have been restored <br />to a stable configuration consistent with the premining topography and with effective surface <br />drainage. Adequate vegetation has been reestablished on the EMD and 18 -Right Shaft areas to <br />stabilize soil materials and protect against erosion, although revegetation success sampling and <br />evaluation have not yet been scheduled for these areas. Given that TC has achieved these <br />reclamation milestones, and consistent with applicable regulatory provisions for partial bond <br />release under Rules 3.03.1(2)(a) and (b), TC is requesting CDRMS approval for: <br />Phase I Partial Bond Release for completion facilities demolition and removal, shaft <br />sealing, and backfilling, grading, drainage control, and soil material replacement and <br />reseeding (as applicable for the defined areas) in accordance with applicable provisions of <br />Rule 3.03.1(2)(a) <br />
