Division also stated that there were no concentration's that would be of <br />concern of groundwater contamination. The Division also reviewed Colowyo's <br />AHR and DMR data under SL -05. The Division concurred with Colowyo's <br />statements above in the SL -05 Decision Document. The statement of no <br />groundwater contamination and approval of SL -05 by the Division is another <br />justification that hydrologic impacts from Colowyo's mining operation are <br />minimal enough to allow for Phase 111 release. Given that the Division has <br />previously reviewed and stated, in writing, that all impacts from mining to <br />surface water and groundwater have not impacted the hydrologic balance <br />outside the permit boundary, the Division has agreed with Colowyo that <br />point(s) of compliance are not necessary for the current operation. For a full <br />narrative of the Division's agreement on minimal impacts to surface and <br />groundwater please refer to the SL -05 Proposed Decision and Findings of <br />Compliance document pages 7 through 9. <br />As Colowyo has clearly demonstrated above, point(s) of compliance are not <br />necessary for the existing operation. Colowyo's surface, subsurface water <br />monitoring data and overburden suitability analysis supports this conclusion, <br />as well as the Division's concurrence and approval of SL -05. Colowyo firmly <br />believes that points of compliance have been addressed for the current <br />operation and the Division has reviewed and approved items which are <br />directly related to points of compliance. In closing, the Division has also stated <br />within the Proposed Decision and Findings of Compliance document for SL -05 <br />that, "...the Colowyo Mine has not caused hydrologic changes that adversely <br />affect the approved post- mining land use in the permit area." This statement <br />along with 30 years of Colowyo's site water monitoring data, does not indicate <br />any elevated levels of concern, and therefore dictates that point(s) of <br />compliance for the existing operation are unnecessary. <br />Colowyo believes the analysis included herein, satisfies and resolves the Division's <br />request to for a groundwater point of compliance analysis for Stipulation 7.
