Conventional wisdom <br />would suggest that monitoring results should demonstrate mostly static <br />concentrations or level trends of monitored parameters over time at sampling <br />locations above gradient of mining activities. Further, one could reasonably <br />expect that monitoring locations below gradient or downstream from mining <br />activities would reveal trends increasing the concentration of certain <br />parameters. However, we see nearly the opposite phenomenon expressed. A <br />reasonable conclusion that can be reached from this situation is that at a <br />minimum, mining activities are not having a detrimental effect on the shallow <br />groundwater resource and if anything are leading to shallow groundwater <br />quality condition improvement. The data presented in the AHR and under this <br />cover suggest at a minimum that pollutants are not a concern in surface water <br />and shallow alluvial groundwater and a point(s) of compliance for the current <br />operation continues to be unjustified. <br />Additional relevant surface water monitoring results supporting the data <br />presented above is thirty years of NPDES discharge monitoring data. Results <br />indicate, with the exception of storm events and melting events, sampled <br />A Western Fuels- Colorado, LLC mining property <br />
