The most recent SWSP <br />approval letter was dated May 21, 2012, with an amendment to the 2011 -12 plan approved on <br />August 8, 2012. The mine is permitted with the Division of Reclamation, Mining, and Safety <br />under File No. M -97 -054. The operation consists of sand and gravel production and will impact <br />the Arkansas River in the form of depletions due to evaporation and operational losses associated <br />with mining; including dewatering, dust control, and water retained in product hauled off site. <br />Mining above the groundwater table has been completed, and the Applicant will <br />commence mining below the groundwater table during this plan period (October 1, 2012 through <br />September 30, 2013). All mining will occur in a dewatered state. The DRMS permit has been <br />amended to show that mining will occur below the groundwater table, and the appropriate <br />consumptive use percentages have been applied to the material mined from beneath the <br />groundwater table. Mining at the site is estimated to continue for approximately 15 years. <br />In accordance with the letter dated April 30, 2010 (see attached) from the Colorado <br />Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining <br />operators must comply with the requirements of the Colorado Reclamation Act and the <br />Mineral Rules and Regulations for the protection of water resources. The April 30, 2010 <br />letter from DRMS requires that you provide information to DRMS to demonstrate you can <br />replace long term injurious stream depletions that result from mining related exposure of <br />ground water. <br />In accordance with approach nos. 1 and 3, you have indicated that a bond has <br />
