Thank you for your prompt <br />submittal of this report. Only one pond discharged during the reporting period, the WWTF pond. There was an <br />exceedance in the reported TSS value for the daily max and 30 -day average for the WWTF pond. The reason <br />given was that there has been a problem, historically, with sediment, from coal fines, entering the pond. Given <br />the Divisions observations during its monthly inspections, this explanation seems plausible. With the installation <br />of the enclosed septic tank as a polishing pond, this should take care of this problem. As such, Mountain Coal <br />has asked for relief from the CDPHE WQCD. Please keep the Division informed with regards to how the WQCD <br />is proceeding with this exceedance. The Division does not have any further comments or questions regarding the <br />West Elk Mine's 3Q12 DMR's.
