SCHEDULE TO NOTICE OF VIOLATION <br />Notice of Violation No.: CV- 2012 -008 <br />NATURE OF VIOLATION: <br />OMLLC failed to obtain approval for and submit a reclamation bond for a revision to the surface coal <br />mining and reclamation operations prior to implementation. <br />ACT, REGULATION, OR PERMIT PROVISIONS) VIOLATED: <br />ACT SECTION(S): 34 -33 -115 (1) <br />REGULATION SECTION(S): 2.05.3(3)(a), 3.02.1, 4.04 <br />PERMIT SECTION(S): <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />This notice applies to the electrical substation that was constructed in conjunction with the methane <br />fueled electric generating station in the upper Elk Creek facilities area.
