STATE OF COLORADO <br />.0 <br />COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT �w - <br />AIR POLLUTION CONTROL DIVISION ti <br />TELEPHONE: (303) 692 - 3150 <br />* 1876 <br />CONSTRUCTION PERMIT <br />PERMIT NO: 88M0234F <br />FINAL APPROVAL <br />DATE ISSUED: JANUARY 20, 2006 Modification #3 <br />ISSUED TO: Western Fuels Colorado, LLC <br />THE SOURCE TO WHICH THIS PERMIT APPLIES IS DESCRIBED AND LOCATED AS FOLLOWS: <br />Surface coal mine known as the New Horizon Mine located immediately west of the town of <br />Nucla, Montrose County, Colorado. <br />THE SPECIFIC EQUIPMENT OR ACTIVITY SUBJECT TO THIS PERMIT INCLUDES THE FOLLOWING: <br />Open pit coal mining and related activities including excavation, placement and storage of <br />topsoil/overburden, and coal, vehicle haul roads, site disturbance, and blasting and drilling of <br />overburden, and associated activities. <br />THIS PERMIT IS GRANTED SUBJECT TO ALL RULES AND REGULATIONS OF THE COLORADO AIR <br />QUALITY CONTROL COMMISSION AND THE COLORADO AIR POLLUTION PREVENTION AND <br />CONTROL ACT C.R.S. (25 -7 -101 et seq), TO THOSE GENERAL TERMS AND CONDITIONS INCLUDED <br />IN THIS DOCUMENT AND THE FOLLOWING SPECIFIC TERMS AND CONDITIONS: <br />The particulate emission control measures listed on the attached page (as approved by the <br />Division) shall be applied to the particulate emission producing sources as required by Regulation <br />No. 1, Section III.D.1.b. <br />2. This permit is for mining related activities only, any process equipment (i.e. crushers, screens, <br />etc.) to be located at this site must have a separate permit from the Division. (Reference: <br />Regulation No. 3, Part B, Section III.E.) <br />The Division's approval of the control plan is based on the submitted production levels as listed <br />below. Prior to any increase in daily or annual production rates, the applicant shall submit an Air <br />Pollutant Emission Notice and Control Plan revision which will be subject to Division review and <br />approval to ensure compliance with the National Ambient Air Quality Standards for particulate <br />matter. Records of the actual production rates shall be maintained by the applicant and made <br />available to the Division for inspection upon request. (Reference: Regulation No. 1, III.D.1.b.) <br />Production of coal shall not exceed 2200 tons per day and 425,000 tons per year. <br />Overburden blasting shall not exceed one blast per day <br />ANFO usage shall not exceed 3,500,000 pounds per year <br />Stockpiling of coal shall not exceed 4000 tons <br />085/0036/001 ver. 2 /00 <br />
