Our initial
review indicates that all preliminary items required by Rule 2.08.5(2)(b) have not been submitted. Thus,
your application is incomplete for the purposes of filing as of November 8, 2012. Please address the
following items.

1. The application form submitted is not the form approved and provided by the Division. In
accordance with Rule 2.03.3(6), an application for a surface coal mining reclamation permit shall be
made on the forms provided by the Division. Please resubmit the application on the approved form.
An electronic form is available on the Division’s website:
http://mining.state.co.us/coalForms/RenewalApp.pdf

2. The comment due date on the submitted public notice is incorrect. In accordance with Rule
2.07.3(5), written objections to or comments upon the initial or revised application for a permit
renewal must be submitted to the Division within 30 days after the last date of the publication of the
required notice.

In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise make your
application complete. Rule 2.08.5(3)(f) requires a complete application for a renewal must be received at
least 180 days prior to the expiration of the permit.
