Remediation activities at the Pond 016A Slide.

Dear Mr. Kirby:

The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34,
Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on November 8, 2012 an
application to revise coal mining operations at the Seneca II-W Mine was considered complete for the
purposes of filing. The revision was submitted by Seneca Coal Company, LLC. All review and comment
periods as provided in the Act and the Regulations initiate from this date of filing.

The revision documents the remediation activities of the Pond 016A slide area. It includes a summary of the
construction activities, maps showing the structure locations and post mining topography, and documentation
from NWCC (engineering firm) regarding material placement and compaction results and a recommendation
to delay topsoil placement until 2013. The revision also modifies the Runoff Control Structures design to
allow dewatering pipes through the embankment to be increased in size if necessary.

The Surface coal mining operation is on land located approximately 9 miles South of Hayden, Colorado.
The permit area is further described as follows:

T5N, R88W; All of Section 15; Portions of Sections 9, 10, 11, 14, 16, 21, 22, 23, 26, 27, 34, and 35
T6N, R88W; Portions of Sections 14, 23 and 24
T6N, R87W; Portions of Sections 17, 18, 19

The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Hayden Gulch.

The applicant is required to publish notice in a local newspaper that this application has been deemed
complete. At the time of publication of this notice, the applicant is additionally required to place a copy of
this application at the Hayden Public Library, 201 E. Jefferson Avenue, Hayden, CO 81639-1813, and at
