To summarize, the existing use is operating without approvals, which is a violation of the Boulder <br />County Land Use Code. To abate this violation you must either: <br />• Apply to the Land Use Department for Special Use Review by 3 December 2012, and <br />thereafter receive approval through Special Use Review for an Open Mining Use pursuant to <br />Article 4- 508(D) of the Land Use Code; <br />OR <br />• Cease and desist the mining operations on the property by 3 December 2012. <br />The first step in the Special Review process is to schedule a pre - application conference with a <br />Planner to review the application materials and requirements for submittal. This can be done by <br />calling the Planning Division at 303.441.3930.
