O'Connor Blvd, Suite 200 <br />Irving, Texas 75039 <br />Re: Jemadojin Sand Mine, Permit No. M- 2006 -017, Pending Application For Transfer of Mineral <br />Permit and Succession of Operator <br />Dear Mr. Connolly: <br />On August 27, 2012, the Division of Reclamation, Mining and Safety received your Application for <br />Transfer of Mineral Permit and Succession of Operator. We are currently waiting for the Annual Report for <br />2011 -2012 from Oglebay Norton Industrial Sand, Inc. A request for the Annual Report was sent to Michael <br />Miclette and Paul Banks last week. <br />Forms required to complete the Succession of Operator will be: Affidavit of Authority, Performance <br />Warranty and Financial Warranty. These template forms can be found at the Division's website, <br />www.mining.state.co.us . Please provide the Affidavit of Authority and Performance Warranty for Premier <br />Silica LLC now, with your Application. Upon receipt of these two forms and the Annual Report, the permit <br />transfer can be approved. You will then be contacted by an Environmental Protection Specialist regarding <br />the site for an inspection and notified thereafter of the reclamation cost and amount of Financial Warranty to <br />provide within 60 days.
