OBSERVATIONS <br />PERMIT #: M- 2012 -018 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: October 11, 2012 <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Brenda Buster of Stone Canyon Quarry, LLC was also present for the inspection. The Stone Canyon <br />Quarry is located approximately 2 miles north of Lyons, CO. <br />On July 12, 2012, the Mined Land Reclamation Board (Board) found the Operator in violation of C.R.S. 34 -32.5- <br />109(1) for failing to obtain a reclamation permit prior to engaging in a new operation. The Board ordered the <br />Operator to submit a Construction Materials Reclamation Permit Application to incorporate the disturbed <br />area. The Division received an application for a 112 Construction Materials Reclamation Permit on September <br />7, 2012; the current decision date is December 13, 2012. This pre- operation inspection was conducted as part <br />of the Division's regular monitoring program. The Operator had posted notice of the proposed mining <br />operation at the site entrance as required by Rule 1.6.2(1)(b). <br />The Stone Canyon Quarry is situated on the east side of a hogback in Stone Canyon; the approximate elevation <br />is 6,000 ft. The site is located in a historically quarried area and remnants of an historic quarry can be found in <br />the southwest corner of the proposed permit area. The proposed permit area will be 31 acres in size and will <br />roughly correspond to the property boundary; the commodity to be mined is moss rock. The Operator has a <br />residence on the east side of the permit area; the house and the immediately surrounding area will not be a <br />part of the affected acreage. The structures within 200 feet of the permit boundary include: Stone Canyon <br />Road, Poudre Valley REA overhead line, Century Link overhead line, and fences on the north and west sides of <br />the site. The fences were not depicted on the Mining Plan map; this will be addressed in the Division's <br />adequacy review of the application. <br />The Operator had previously created a small access road which is situated on the south side of the property; <br />the road runs from the main access road on the east towards the west side of the site. This road will be <br />utilized for the collection of moss rock and the Operator has requested that the road remain after the <br />completion of reclamation. The moss rock will be removed primarily by hand or by mechanized equipment, <br />such as a carryall. The surface disturbance associated with this operation is expected to be minimal. There are <br />no ponds or streams on the property and the operation is not expected to affect groundwater systems. <br />The Division did not make any observations which would prevent the approval of the 112 Construction <br />Materials Reclamation Permit application.
