PERMIT #: M- 1989 -056 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: September 27, 2012 <br />the Division's policy in regard to how sites with exposed groundwater are bonded. According to the Operator, <br />an augmentation plan has been filed with the Office of the State Engineer. The Operator is not currently in <br />compliance with the Division's policy for sites with exposed groundwater. This has been cited as a problem <br />and will require corrective action by the Operator; please see the first page of this report for additional <br />information. <br />As part of the approval of Amendment No. 1, the Operator committed to installing three monitoring wells. The <br />groundwater levels in the monitoring wells are to be measured on a quarterly basis, with the monitoring data <br />submitted to the Division with the Annual Report. The Division has not received any groundwater monitoring <br />data for 2011 and 2012. This has been cited as a problem and will require corrective action by the Operator; <br />please see the first page of this report for additional information. <br />Revegetation: <br />As noted earlier in the report, Phase la-lc has been reclaimed to wetlands. The wetlands appear to be well <br />established and the Division noted a variety hydrophytic species growing in and around the wetlands. The <br />Division observed tamarisk and russian olive around the perimeter of the wetlands. The noxious weeds are <br />treated annually through mowing and chemical applications. The Operator has done an excellent job in <br />preventing the spread of these noxious weeds by following their Weed Control Plan. <br />Support Facilities On -site: <br />The office, maintenance shop, equipment storage area, asphalt batch plant and concrete batch plants are <br />located adjacent to County Road 5 in Phase 5. All fuel was being stored in approved storage containers; no <br />spills were observed. <br />Financial Warranty: <br />The Division currently holds a financial warranty in the amount of $207,700.50. The last financial warranty <br />calculation was performed in 2008. The bond amount remains sufficient to complete reclamation, provided <br />the Operator can demonstrate the exposed groundwater will be covered under a court approved <br />augmentation plan. The Operator can also address the bonding liability associated with the exposed <br />groundwater by dedicating water shares to the Office of the State Engineer. If the Operator is unable to come <br />into compliance utilizing one of the above options, then the Division will have to recalculate the financial <br />warranty to account for backfilling the site to two feet above the static groundwater level or to account for <br />installing a clay liner or a slurry wall. <br />This concluded the inspection. <br />Page 3 of 5 <br />
