24. Burdens of Proof. Applicants have complied with all requirements and met <br />all standards and burdens of proof and are therefore entitled to a decree <br />confirming and approving the subject appropriative rights of exchange as <br />described herein. <br />25. No Injury. The subject appropriative rights of exchange, if exercised and <br />administered in accordance with the provisions of this Decree, will not cause <br />injury to any owner of or person entitled to use water under any vested water <br />right or decreed conditional water right. <br />JUDGMENT AND DECREE <br />Case No. 2002CW389 <br />Page 23 of 28 <br />26. The foregoing findings of fact and conclusions of law are incorporated <br />herein by this reference as if set forth fully herein. <br />27. The Application is granted, subject to the provisions of this Decree. <br />28. Subject to the provisions of this decree and the terms and conditions <br />below, the plan for augmentation is approved. <br />A. Parties seeking participation in this plan, in cooperation with the <br />Districts, shall follow the process outlined in paragraph 8(C), above. The <br />Districts shall not submit an Application to the State Engineer, nor include <br />in this plan, any Participating Diversion which is not within the procedure <br />approved by this Decree. <br />B. This plan for augmentation shall permit Participating Diversions to <br />divert water located within the Service Area boundaries, provided that such <br />diversions are located within the boundaries of the Service Area and the <br />consumptive use depletions from such diversions are calculated and <br />replaced in time, place and amount pursuant to this decree. <br />C. The Districts shall replace all out -of- priority depletions that result <br />from the operation of Participating Diversions. The Districts shall require <br />metering of all Participating Diversions pursuant to paragraph 8 of this <br />decree. If depletions calculated using actual meter readings and the <br />consumptive use criteria in paragraph 8 are greater than presumptive <br />depletions for any Participating Diversion, Applicants shall replace those <br />additional depletions on a weekly basis during the irrigation season, and a <br />monthly basis during the non - irrigation season. In addition, if depletions <br />calculated using actual meter readings and the consumptive use criteria in <br />paragraph 8 are greater than presumptive depletions for any Participating <br />Diversion, the Applicants plan projection for the coming year as required in <br />
