Case No. 2002CW389 <br />Page 14 of 28 <br />Denver and Centennial, as further described in paragraphs 9(A)(3) <br />and 30(F). <br />3. Depletions on Tarryall and Michigan Creeks. Water rights <br />leased or owned by Centennial and changed in Case Nos. 05CW111 <br />and 99CW199(A) and 99CW199(B) ( "Centennial's water rights ") are <br />measured at the MCHJEFCO gage on Michigan Creek (05CW111) or <br />Centennial's gage on Tarryall Creek (99CW199), respectively <br />( "Centennial's quantification points "). In order to prevent injury to <br />Centennial's water rights, the Districts shall have the following <br />obligations with respect to replacement of out -of- priority depletions <br />on Tarryall and Michigan Creeks: <br />(a) Any depletions from Participating Diversions to Tarryall <br />Creek or Michigan Creek located above Centennial's applicable <br />quantification point during times when Centennial's water <br />rights are in priority and receiving less than their decreed <br />entitlement shall be replaced upstream of Centennial's <br />applicable quantification point. Alternatively, if the Districts <br />are unable to replace the depletions upstream of Centennial's <br />applicable quantification point due to lack of available <br />replacement water upstream of the applicable quantification <br />point, the quantity of such depletions shall be added to the <br />measured amounts at Centennial's applicable quantification <br />point for purposes of determining Centennial's entitlement <br />under the applicable decree in Case No. 05CW111, <br />99CW199(A), or 99CW199(B) and the Districts shall then <br />cause the release of water or bypass consumptive use direct <br />flow water from any source described in paragraph 6 in an <br />amount equivalent to the amount of such depletions caused by <br />the Participating Diversions, above the applicable <br />quantification point, plus transit losses for any length of <br />stream between the point of release and Centennial's point of <br />downstream diversion that is greater than the distance <br />between the applicable quantification point and Centennial's <br />point of diversion downstream, and such amount shall be <br />available for diversion downstream by Centennial as reduced <br />by any transit losses. Centennial shall be responsible for any <br />transit losses assessed against the released or bypassed water <br />for the distance equivalent to the distance between the <br />applicable quantification point and Centennial's downstream <br />diversion point. <br />(b) Any depletions from Participating Diversions to Tarryall <br />Creek or Michigan Creek during times when other water rights <br />
