Notice of Application for Participating Diversion in <br />Augmentation Plan <br />DATE: October 2. 2012 <br />The Headwater Authority of the South Platte (HASP), as operator of the augmentation plan <br />decreed in Case No. 02CW389 in the District Court for Water Division No. 1, hereby gives <br />notice to the Objectors to that application that the following Application for a Participating <br />Diversion has been received by HASP, which application and supplemental materials, if any, <br />are attached for your review and comment. <br />1. Name of Applicant for Participating Diversion: Golden Cross Aggregates. Inc, <br />2. Amount of uncommitted replacement water available to the Districts after the <br />approval and inclusion of the proposed Participating Diversion in this augmentation plan: <br />a. Total augmentation water adjudicated: 66.2 a/f <br />b. Amount committed to previous participating diversions and the one proposed <br />herein: 18.90 a/f <br />c. Balance of uncommitted replacement water: 47.30 a/f <br />3. Participating Diversion is located on Tarryall or Michigan Creeks? Yes _ No X <br />4. Applicant claims that 37- 92- 102(3)(b), C.R.S. applies? Yes _ No X <br />If yes, attached is an affidavit and any available evidence showing the uses or exchange of <br />water existed before the CWCB appropriated the potentially affected instream flow water <br />right. <br />5. You are hereby advised that you may file comments with the Districts and the State <br />Engineer, within thirty (30) days of the date of this notice, except that comments may be filed <br />within sixty (60) days for applications for commercial or industrial use. If no comments to <br />this application are received and the time for comments has expired, the Districts may <br />approve the application and then submit the approved application to the State Engineer for <br />processing, if necessary. <br />6.
