Box 670 <br />Hayden, CO 81639 <br />Re: Yoast Mine (Permit No. C- 1994 -082) <br />2011 Annual Reclamation Report <br />Adequacy Review Response — Additional Questions <br />Dear Mr. Karo: <br />The Division has reviewed SCC's response to our review comments on the 2011 Annual <br />Reclamation Report submitted for the Yoast Mine. The Division noted that location of the 2011 <br />shrub plantings does not appear to be depicted on the "Chronological Seeding" exhibit <br />accompanying the report, and asked that SCC revise the exhibit. SCC responded with revised <br />report pages to further describe the location. The exhibit, however, still indicates that all three areas <br />were planted prior to 2011. Rule 4.15.7(5)(f) allows for limited replanting within the first four years <br />of any ten year liability period. For the 2007 and 2010 shrub plots, the 2011 replanting was within <br />that allowable four years. For the 2003 plot in the north pit, this replanting was outside of the <br />allowable timeframe for replanting without re- initiating the reclamation liability period. <br />Accordingly, the exhibit should be revised to reflect that the plot was replanted in 2011.
