STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866 -3567
FAX: (303) 832 -8106
November 2, 2012
Mr. Tony Tennyson
Colowyo Coal Company, LP
5731 State Highway 13
Meeker, CO 81641
Re: Colowyo Mine C- 1981 -019
Further Adequacy Review for Permit Renewal Number 6 (RN -06)
Dear Mr. Tennyson:
COLORADO
D I V I S ION Of
RECLAMATION
MINING
SAFETY
John W. Hickenlooper
Governor
Mike King
Executive Director
Loretta Pineda
Director
Thank you for working with me on some of the numbers in your renewal application, namely
surface ownership acreages. Since you have provided your last response (letter of October 23,
2012), I have looked at the numbers again and identified further potential issues. We need to
discuss and try to resolve the following discrepancies between the numbers on page 3 of your
RN -06 application and the numbers in the DRMS Permit System.
The mineral ownership numbers on page 3 of your RN -06 application are:
• Federal: 11,201 acres
• State: 1,280 acres
• Private: 513 acres.
In our Permit System we have:
• Federal: 9,956 acres
• State: 650 acres
• Private: 1,644 acres.
2. The disturbed and affected area listed on page 3 of your RN -06 application is 4,800.6 acres,
but it should be less to reflect the reduction in acreage from SL -05. The amount of area
released with SL -05 was 979.5 acres. The result of 4,800.6 less 979.5 is 3,821.1 acres.
However, the number in our Permit System is 3,786 acres. (I do realize that the RN -06
application was submitted before SL -05 was approved, however I think it makes sense to
address this now, especially given the discrepancy between 3,821 acres and 3,786 acres.)
The bond release areas on page 3 of the RN -06 application (approximately 1,415 ac for 60%
and approximately 1,341 ac for 85 %) are approximately 18 acres less than what we have in
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
