Interoffice Memorandum <br />To: Jim Stark <br />From: Zach Trujillo <br />Subject: West Elk Mine —Third Quarter 2012 RPE and RPE East Monitoring Report <br />Date: 10/31/2012 <br />Jim — <br />After my review of the Third Quarter RPE and RPE East Reports for the year 2012, 1 find the report in compliance with <br />the following rules: <br />1. 4.09.1(11)(a) —The fill was inspected for stability by a registered engineer during the placement and compaction <br />of fill materials. <br />2. 4.09.1(11)(b) —The qualified registered engineer provided to the Division a certified report within two weeks <br />after the inspection that the fill is being constructed as specified in the design approved by the Division. The RPE <br />and RPE East were inspected on August 16, 2012 while monitoring of RPE East was daily throughout the third <br />quarter. Repairs were conducted for cracks, settling and seepage at the site but no appearances of instability, <br />structural weakness, and other hazardous conditions were noted in the inspection report. <br />3. 4.09.1(11)(c) — Colored photographs of the underdrain during its construction on September 9th, 2012 was <br />included in the report. Photos were taken during the placement of the filter fabric, riprap lining and final <br />covering of the underdrain with refuse. <br />4. 4.10.2 —All criteria for Rule 4.10.2 were met. <br />Comparisons between second and third quarter Lower Refuse Pile Monitoring Surveys show no signs of slumping or <br />sliding and have maintained the same elevation with an estimated average deviation around +/- .1ft. The RPE East's <br />compaction results were in the range of 93 — 100 percent relative compaction which exceeds the minimum requirement <br />of 90 percent per Rule 4.10.4(3). Additionally, final construction of lined and riprapped ditches, plumes and pipes <br />contained through the third quarter and are ongoing. Repair of the RPE ditches impacted by the Haul Road landslide <br />also continues. <br />The 2012 Third Quarter RPE and RPE East Monitoring Reports for West Elk Mine meet all rules required by the Division. <br />If you have any questions, feel free to contact me. <br />Sincerely, <br />Zach <br />
