(4)The Operator shall establish reasonable timetables consistent with good mining and <br />reclamation Procedures: All backfilling and grading will be completed as soon as feasible <br />after the mining process. The Operator will establish a reasonable timetable consistent with <br />good mining and reclamation procedures. Backfilling will be an ongoing process. Grading will <br />be performed, as backfilling is completed and consistent with mining sequencing, stockpile <br />location and need, processing, and efficient equipment movement and availability. <br />Grading of final pit slopes will occur as mining approaches the toe of the interior slopes and <br />will not be steeper than 3h: lv in those cell locations where a zoned perimeter dam will not be <br />constructed. Since the pit floors will be underwater, no grading or topsoil replacement will <br />occur there. Topsoil replacement and smoothing will be accomplished after mining has moved <br />far enough away from an active mining or construction area to protect the topsoil and make it <br />practical for seedbed preparation and seeding. Final seeding and seedbed preparation will also <br />be governed by the time of year and weather conditions that are optimal for these activities. <br />(5) All refuse and acid - forming or toxic producing materials that have been mined shall be <br />handled and disposed of in a manner that will control unsightliness and protect the <br />drainage system from pollution: No refuse or toxic or hazardous material is expected to be <br />generated by this mining operation. Waste material may be produced as part of the concrete <br />and/or asphalt batch plants. Where such material is produced, it will be handled in such a <br />manner that conforms to local, State and Federal requirements for disposal of such material. <br />The Operator does not intend to dispose of toxic or hazardous materials on the mine site. <br />(6) Any drill or auger holes that are part of the mining operation shall be plugged in <br />accordance with methods approved by the Division: No adits or shafts will be employed in <br />this operation. All drilled or auger holes will occur within the limits of the slurry wall or area <br />excavated by the mining operation, therefore ground water resources will not be impacted. <br />However, if any drill, backhoe pits or auger holes are required outside the confines of the slurry <br />walls or zoned perimeter dam, they will be constructed by trained crews and shall be backfilled <br />as soon as practicable. <br />(7) Maximum slopes and slope combination shall be compatible with the configuration of the <br />surrounding conditions and the selected post mining land use: The proposed post mining <br />land use will be developed water resource. This Pueblo County approved post mining land use <br />is a change from the existing land use, agricultural land. The final interior pit slopes will not be <br />steeper than 3H: 1V. The constructed dams that will surround the excavated areas will be <br />according to site - specific designs for earthen dams approved by the SEO. <br />(8) Not applicable <br />(9) Placement of inert structural fill imported from off -site: At this time the Operator does not <br />intend to import inert structural fill from off -site since on -site construction materials appear <br />suitable for developed water resource facilities construction.
