3.1.4 Public use: <br />and agreed upon with the Division during submittal of the Technical <br />revision. <br />• The trench width will be based on site - specific conditions and will be <br />ensured by specifying that the excavation bucket be of a specified <br />width. <br />• The completed slurry wall will be capped to protect it from desiccation, <br />traffic, and plant root growth. The contractor will be required to load <br />the top of the slurry wall using onsite material to a height of one and <br />one half to three feet above ground level. Once the backfill is stable, <br />generally two weeks, the loaded material will be removed and a final <br />cap will be installed. <br />(b) A comparison of the proposed post- mining land use to other land uses in the <br />vicinity and to adopted State and local land use programs. Where the post mining land use is for <br />commercial purposes, appropriate evidence supporting such reasonable assurance shall be <br />submitted, if not, a plan for revegetation shall be submitted: <br />This site is located in a Zoned A -1 Agricultural area. The proposed post mining land use will be <br />developed water resource and rangeland. The proposed operation has been through the Pueblo County <br />Special Use Process (SUP 2007 -006) and found be to be an acceptable use as a developed water <br />resource. <br />The Evans Pit #2 (Permit # M- 2000 -041) is to the south of Phase One. The site is owned by the <br />Operator /Applicant (Stonewall Springs Quarry, LLC.) and is currently under lease to Fremont Paving <br />and Redi -Mix, Inc. <br />The St. Barbara Sand and Gravel Mine (MLRB M- 2004 -013) are south of the Phase Two cell and is <br />owned and operated by Pete Lien & Sons, Inc. <br />The Bluegrass Gravel Pit (MLRB M- 2008 -001) is west of the proposed main stockpile area west of <br />Nyberg Road. <br />Chico Creek acts, as a natural buffer on the east side of the proposed Operation and U.S. Highway 50 is <br />a manmade buffer on the north side of the proposed Operation. <br />(c) A description of how the Reclamation Plan will be implemented to meet each <br />applicable requirement of Section 3.1: <br />3.1.1 Establishing the post- mining use: <br />(1) In consultation with the Landowner, where possible, subject to the approval of the Board <br />or Office, the Operator shall choose how the affected lands shall be reclaimed: <br />The Operator /Applicant, and as the landowner, has decided to reclaim the majority of the affected area <br />to water storage reservoirs, a Developed Water Resource (WR). Stockpile and processing areas will be <br />reclaimed to Rangeland (RL). Haul roads will remain as access to the water storage reservoirs. <br />(2) Have the results of these decisions been formulated in to a viable reclamation plan: <br />The results of this Application process and all of the decisions formulated into it constitute what the <br />Applicant considers is an appropriate and viable Reclamation Plan as contained herein. <br />3.1.2 Reclaiming Substituted Land: <br />The Applicant/Operator does not intend to substitute other land for reclamation. <br />3.1.3 Time Limit and Phased Reclamation: <br />Reclamation will be conducted in phases to coincide with the phase of mining described in Exhibit <br />"C ", Mine Plan Map. Each phase of reclamation will be completed with all reasonable diligence. <br />
