Xcel Energy <br />May 22, 2008 Attach to PSCo Document No. 170150 <br />Mr. Mark Morley <br />Stonewall Springs Quarry, LLC <br />20 Boulder Crescent — r Floor <br />Colorado Springs, CO 80903 <br />RE: Electric Transmission Lines <br />Dear Mr. Morley, <br />This letter is being sent to you in response to a request you made to Andy Horvat, <br />Contract Agent, Siting and Land Rights, Public Service Company of Colorado (PSCo). <br />Stonewall Springs Quarry, I.LC (Stonewall) has requested that PSCo provide you with a <br />notarized letter stating that PSCo's facilities will not he negatively affected by the <br />development and operation of the Stonewall Springs quarry, or by the construction and <br />operation of the reservoir or pipeline to be built on the quarry site upon the removal of <br />gravel from the property. <br />PSCo understands that this request is necessary in order for Stonewall to be in <br />compliance with Rule 6.4.19, Exhibit S — Permanent Man -made Structures, Paragraph C, <br />of the Mineral Rules and Regulations of The Colorado Mined Land Reclamation Board for <br />the Extraction of Construction Materials, relative to Stonewall's State of Colorado <br />application for a permit for the gravel mining operation. <br />Pursuant to the terms and conditions of the attached PSCo Easement (PSCo <br />Document No. 170150). and the License Agreement related to the easement, which was <br />agreed to and executed by PSCo and Stonewall Springs Quarry, LLC, the mining and <br />reclamation activities as proposed, including the water pipeline and reservoir construction <br />and ancillary facilities will have no negative effect to the PSCo facilities located within the <br />boundaries of the Easement. <br />1 trust that this letter satisfies your request regarding this matter.
