The proposed location of the <br />mining operation is east of Nyberg road between SH 96 and US 50. We can offer the following; <br />CDOT hopes you will accept this letter in lieu of a signed and notarized Permanent Man -Made <br />Structures Letter of Agreement. Additionally, CDOT will be issuing an Access Permit for a <br />change in use to the existing Nyberg Road to accommodate the additional trucks and traffic <br />volumes assoclated with the mining use. The access permit is a legal and binding contract <br />between the property owner and CDOT. <br />The Access Permit allows CDOT to require improvements to the state highway fadlity <br />(permanent structure) if warranted and to provide design criteria for the construction of those <br />improvements as well as safety measures to be taken during construction. <br />
