The Colorado Department of Transportation is In receipt of a request compliance with Rule
6.4.19 Exhibit S requiring a statement from all owners of any PERMANENT MAN -MADE
STRUCTURES that are within 200 feet of the affected area. The proposed location of the
mining operation is east of Nyberg road between SH 96 and US 50. We can offer the following;
CDOT hopes you will accept this letter in lieu of a signed and notarized Permanent Man -Made
Structures Letter of Agreement. Additionally, CDOT will be issuing an Access Permit for a
change in use to the existing Nyberg Road to accommodate the additional trucks and traffic
volumes assoclated with the mining use. The access permit is a legal and binding contract
between the property owner and CDOT.
The Access Permit allows CDOT to require improvements to the state highway fadlity
(permanent structure) if warranted and to provide design criteria for the construction of those
improvements as well as safety measures to be taken during construction.
