UNITED STATES DEPARTMENT OF THE INTERIOR <br />OFFICE OF HEARINGS AND APPEALS <br />BOARD OF LAND APPEALS <br />) <br />WILDEARTH GUARDIANS ) IBLA No. 2013- <br />) <br />Appellant ) <br />) <br />) <br />) <br />NOTICE OF APPEAL <br />Pursuant to 43 C.F.R. §§ 4.410, 4.411, and 4.413, WildEarth Guardians hereby appeals to the <br />Interior Board of Land Appeals and files this Notice of Appeal of a decision made by Bureau of Land <br />Management ("BLM") Colorado Uncompahgre Field Office Manager, Barbara Sharrow. Ms. Sharrow's <br />decision authorizes issuance of the Oak Mesa Coal Exploration License, COC- 74911, to Oxbow Mining, <br />LLC. This decision is documented in a Decision Record ( "DR ") signed by Ms. Sharrow on September <br />11, 2012. The DR licenses 13,873 acres of coal for exploration in the Oak Mesa area of Delta County, <br />Colorado. The DR authorizes Oxbow to drill 43 exploration wells on private and public lands and was <br />supported by a Finding of No Significant Impact ( "FONSI ") also signed by Ms. Sharrow on September <br />11, 2012.
