Section V: REVIEW AND DISCUSSION: <br />This section consists of questions or comments raised as a result of the Division's review of the permit <br />application, related materials, and review of the reclamation cost estimate. As allowed by Rule <br />2.08.3(3), the Division will require the operator to submit a technical revision responding to the issues <br />identified below. <br />Rule 2.03: Legal, Financial, Compliance and Related Information <br />1. Please assure that MSHA permit numbers associated with the RDA, DWP, DWDA #2, and <br />temporary development waste storage area are included in the permit (p. 2.03 -5), (Rule <br />2.03.4(4)(a) and Rule 2.03.10). Please update Table 2 to assure that all current permits and <br />licenses are included in the table. Please add a third column to Table 2 to add dates of issuance <br />of licenses and permits in accordance with Rule 2.03.10(4). <br />2. Please assure that all Air Emissions Permits are listed in Table 2. The Division has noted that <br />APEN 09- LA0590 is not listed in Table 2. Please update this table. <br />3. During the October 2012 inspection, the Division noted NECC has been issued a Radioactive <br />Materials License. This license is not listed in Table 2. Please assure that information pertaining <br />to this license is included in Table 2. <br />4. Please assure that any changes or updates to owners of surface or coal reserves since the last <br />updates, Map 1 updated 5/12/2011, Map 2 updated 2/1/2012, and permit page 2.03 -5 and 5a, <br />reflect the most current ownership status. (Rule 2.03.4(6)) <br />Rule 2.03.5(3): NOV information has been updated 2/20/2012 with MR108. However, please <br />correct the error on page 2.03 -6a for the termination date for NOV 2011 -006. The correct <br />termination date is December 22, 2011. <br />6. Please update New Elk Coal Company's mailing address. The approved permit still shows the <br />mine address as 122 West First Street, Trinidad, Colorado. Please update this reference to the <br />Weston ,Colorado address. <br />Rule 2.04 Information on Environmental Resources <br />7. Please update page 2.04 -1 to reflect current permitted acreage. The current database (after <br />approval of TR66 on 8/31/2012) shows the approved disturbance area is 222.6 acres. Please <br />update table 4 on page 2.04 -2 as well. This table should reflect the current permitted values: <br />approved permitted acreage equals 4,198.90, and approved affected acreage equals 2,899.21. <br />8. Please assure that T &E species evaluation is up to date with the most current species list. (Rule <br />2.04.11(4)) <br />10 <br />
