As you indicated, no formal proposal has been developed <br />for this project; therefore, we have not reached a decision regarding this issue and are <br />awaiting additional detail about the potential project and specifics of the ablation <br />technology. <br />We do recognize that the proposed process, if implemented as we now understand it, <br />would result in the possession of source material and would, therefore, require a source <br />material radioactive materials license at a minimum. Whether a uranium recovery license <br />would be required is not now determined. <br />Regarding your suggestion that new regulations are required to properly regulate this <br />potential operation, we are unclear as to what specific changes in the regulations may be <br />desired. In the 2009 and 2010 legislative sessions, groups that share many of your <br />concerns and members were successful in modifying the Radiation Control Act to <br />incorporate concerns about in situ uranium mining and uranium recovery regulation. We <br />believe that the current regulatory structure provides adequate protection and control, but <br />would be interested in any specific suggestions you may have. <br />As more information becomes available and when a formal proposal is received, we will <br />determine what specific requirements apply to the potential facility. We will provide you <br />with additional information as it becomes available to us. <br />
