OBSERVATIONS <br />PERMIT #: M -1978 -072 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: October 18, 2012 <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). John DeWitt (Lincoln County Land Use Administrator) and Chris Monks (Road & Bridge Foreman) <br />were also present for the inspection. The Brent Pit is located approximately seven miles north of Arriba, <br />Colorado. The site is permitted for 14.16 acres and the post- mining land use is general agriculture. <br />The permit sign was posted at the site entrance and the boundary of the permit area was clearly delineated by <br />a barbed wire fence. The Brent pit is located immediately south of Hell Creek; the creek is ephemeral and was <br />not flowing at the time of the inspection. Mining is currently progressing to the west; no mining was occurring <br />at the time of the inspection. Topsoil has been stockpiled along the southern and northern edges of the <br />excavation; the topsoil stockpiles were vegetated and did not show any signs of erosion. <br />The Operator is required to maintain a stormwater berm along the south side of Hell Creek. The purpose of <br />the berm is to keep stormwater flowing through the mine site from entering Hell Creek. The berm is intact <br />along the eastern half of the site; however, the berm is nearly non - existent in the area immediately adjacent <br />to the excavation. The condition of the berm has been cited as a problem and will require corrective action by <br />the Operator. Please see the first page of this report for additional information. The Mining Plan calls for <br />maintaining a 30' buffer between the northern edge of the limit of excavation and the south bank of Hell <br />Creek. The Operator has not maintained the required 30' setback; the north edge of the current excavation is <br />with 20' of Hell Creek. The failure to maintain the required setback has been cited as a problem and will <br />require corrective action by the Operator.
