Introduction <br />JD -9 Mine <br />Permit No. M- 1977 -306 <br />Request for Application Amendment <br />The JD -9 mine site is located on the southwestern flank of the Paradox Valley anticline <br />near the axis of the Dry Creek Basin syncline. It is owned and operated by Cotter <br />Corporation (N.S.L.) (Cotter) as a 112 Hardrock/Metal Mining Permit No. M- 1977 -306, <br />originally approved by the Mined Land Reclamation Board on December 15, 1977. <br />Subsequent to permit approval and prior to permit issuance on September 30, 1997, two <br />technical revisions addressing relocation of ventholes and retentions ponds were <br />approved. Cotter is also the lessee of Mining Lease No. AT(05- 1) -ML- 60.8- C -JD -9 <br />renewed by the U.S. Department of Energy (DOE) on April 30, 2008. This lease covers <br />1036.50 acres and gives Cotter the right to explore, develop, mine and remove ore <br />deposits of uranium, vanadium and associated minerals. <br />Cotter previously mined a portion of known reserves in Section 30, T46N, R17W, <br />NMPM, underlying the Burro Canyon Formations. Access to the ore body is by a decline <br />into the Burro Canyon Formation, from the permitted mine site in Section 30, T46N, <br />R17W, located on the northern side of Bull Canyon. The portal is currently covered with <br />a bat gate. <br />Cotter is amending the original permit in order to comply with the Division of <br />Reclamation, Mining and Safety's (DRMS) request. Under the new rules and regulations <br />for Hard Rock Mining, all uranium mines are classified as Designated Mining Operations <br />(DMOs) and require Environmental Protection Plans. Cotter is also amending the permit <br />acreage. The amendment will increase acreage from 11.10 acres to 26.77 acres in order <br />to accommodate the expanding waste rock pile as well as two new treatment ponds. <br />Cotter submits the attached exhibits and maps to provide clarifying information for this <br />request. <br />
