On the same date, the <br /> Mined Land Reclamation Board' (the "Board") issued an order <br /> approving the Agreement and the Schedule contained therein. <br /> The Schedule specified reclamation to be performed by <br /> Resources during 1992 through 1994 if a sale of the mine did not <br /> occur. The Schedule set January 1992 for a meeting before the <br /> Board in which a determination regarding the reclamation <br /> procedures at the mine would take place . <br /> In early 1992, Resources was negotiating with Geneva Steel <br /> for the sale of the mine. Because the Board was aware of the <br /> possible sale, it changed the Schedule by delaying from January <br /> 1992 to August 1992 the meeting where details of the reclamation, <br /> if the mine did not sell, would be determined. In February of <br /> 1992, Resources filed Chapter 11 bankruptcy because it intended to <br /> sell the mine to Geneva Steel, and bankruptcy afforded the only <br /> way to pass title free of encumbrances. In July of 1992, however, <br /> Geneva Steel decided not to purchase the mine. <br /> In August 1992, the delayed meeting was held before the <br /> Board. The Board revoked Resources, mining permit and ordered it <br /> to perform reclamation in accordance with the May 1991 Schedule. <br /> During the winter of 1992-1993 , Resources sent several letters to <br /> the Division, asking it to modify the terms of the Schedule in <br /> 'The Mined Land Reclamation Board was created by the state <br /> legislature as part of the Department of Natural Resources . <br /> C.R.S . § 34-32-105 (1) (1993 Supp. ) .
