II . STATEMENT OF FACTS <br /> Mid-Continent Resources, Inc. ( "Resources") operated a coal <br /> mine in the counties of Pitkin and Gunnison. The area covered by <br /> the permit issued by the Division includes about 11, 000 acres <br /> with approximately 330 acres of surface area affected by the <br /> operation. The defendants have been, and are, actively involved <br /> with Resources' mining operation. Defendant John Reeves is the <br /> president and a director of Resources; Robert Delaney is a vice- <br /> president and a director of Resources; Diane Delaney is the <br /> permitting contact and government liaison for Resources; and Mid- <br /> Continent Minerals Corporation ("Minerals" ) is the parent company <br /> of Resources and wholly owns Resources. All of the defendants <br /> have represented Resources and/or made decisions concerning <br /> Resources, mining operation. <br /> In the 19801s, Minerals and Resources borrowed $52 million <br /> to make changes to Resources' mining operation. (Defendants <br /> Delaney and Reeves are also officers of Minerals) . By statute, <br /> Resources was required to submit a bond to the Division to ensure <br /> that reclamation would be fully performed at the site. In 1988 , <br /> Resources submitted a bond in the form of a deed of trust to <br /> property which included a rockdust plant . The limestone produced <br /> at the rockdust plant was used by Resources in its mining <br /> operation. <br /> Ultimately, after being cited for numerous violations, <br /> Resources entered a settlement agreement with the Division in <br /> -2- <br />
