The Division has come across an issue
concerning whether certain tasks are covered by the M&E contract .
Specifically, the Division would like to know whether the
contract covers the removal of electrical transmission lines
including both the wire strung pole to pole and the wood power
poles.
Paragraph I . C. of the M&E contract defines "equipment" to
include electrical substations and equipment . Paragraph II .A.
then provides that the Contractor will remove and dismantle
electrical substations and transmission lines, and "all other
economically salvageable materials. "
It would appear from these paragraphs that M&E is to remove
the transmission wire and that, therefore, the Division does not
need to perform this task. However, I would like confirmation
from you on this point .
I would also like clarification on whether M&E is required
to remove the power poles as part of the contract . Your
assistance in this matter as soon as possible is appreciated.
Also, I would like to confirm our conversation of January
24, 1995, in which you agreed to provide me with an account of
the administrative expenses, particularly attorneys' fees, which
may be charged against the proceeds from the sale of the
Carbondale Industrial Park. This information is greatly
appreciated. Please call me if you have any questions . Thank
