(3) Identification of Other Agencies' Environmental Protection Measures and <br />Monitoring Requirements. <br />Cotter has taken into consideration the following environmental protection measures: <br />• There are minimal water issues at the LP -21 Mine. It is not anticipated that there <br />will be any effect on the surface or groundwater near or at the mining area, and <br />there will be no water discharge from the mine. Therefore, no discharge permit <br />with the Colorado Division of Water Resources or the Colorado Department of <br />Public Health and Environment (CDPHE), Water Quality Control Division, will <br />be necessary. <br />• Cotter will apply for an air emissions permit if required from the CDPHE for <br />fugitive dust during ore transport and surface operations. <br />• The mine is located on Cotter's patented claims as well as on DOE lands. Cotter <br />will inform the DOE of any changes to the mining plan. This will include <br />obtaining DOE approval for the proposed ventilation hole sites. <br />• The area of the LP -21 Mine is zoned "agriculture" by Montrose County. Cotter <br />has a conditional use permit issued by Montrose County Commissioner's office. <br />• Socioeconomic impacts to the local communities will be positive but limited due <br />to the limited number of employees required at the mine. <br />• Cotter will strictly adhere to all MSHA applicable regulations. <br />(4) Other Permits and Licenses <br />For a full list of Cotter's permits and licenses see Exhibit M - Other Permits and Licenses. <br />(5) Designated Chemical(s) Evaluation <br />No designated chemicals will be used in extractive metallurgical processes onsite. All <br />ore will be transported offsite for processing. <br />Uranium ore and waste rock are not designated chemicals nor do they generate <br />designated chemicals. They are regarded under Hard Rock Rule 1.1 (1) as potentially <br />Acid and Toxic Producing Materials, and are addressed below in section (6) Designated <br />Chemical(s) and Material(s) Handling. <br />O'Connor Design Group Inc.
