The <br />cross sections should be referenced to the geologic map and the cross <br />sections lines need to be shown on the geologic map. <br />MCM: Please see revised Figure 2.5 -1 showing the coal crop lines, strike and dip of the <br />coal seam, coal cross section locations, and surficial geology. <br />Figure 2.5 -2 has not been digitized will remain as it is within the permit document <br />as it is still applicable. <br />Figure 2.5 -3 has been replaced with an updated, digital map. <br />Figure 2.5 -4 is outside the permit boundary and proposed mining area. The data <br />in the cross section is still applicable and does not need to be revised. <br />Figures 2.5 -5 and 2.5 -6 are within the proposed permit boundary and do not <br />need to be revised. <br />Newly created Figure 2.5 -7 represents a cross section of the southern reserve <br />area. <br />Shown on Figure 2.5 -5 is a north -south section that is within a half a mile of the <br />center of the lease modification and should be considered adequate for the lease <br />modification area. A section in the lease mod area could be interpolated, but <br />there are no drill holes in the lease modification area. <br />Rule 2.04.7 Hydrology Description <br />10. Please refer to the enclosed comment letter from the Division of Water <br />Resources, Office of the State Engineer (SEO) dated December 10, 2010 (see <br />Attachment 4). The SEO has identified several concerns with the proposed <br />project as summarized below. <br />• If the stream system at this location becomes over appropriated, the <br />storage and use of any surface or ground water would be subject to <br />administration. <br />MCM: MCM recognizes that if the stream system at the mine becomes over <br />appropriated, the storage and use of any surface or groundwater would be <br />subject to administration. <br />• If any of the sediment ponds expose groundwater, the pond must be <br />backfilled immediately until a well permit issued pursuant to CRS 37 -90- <br />
