Ross Gubka, WFC C- 1981 -008 / SL -13 <br />17 October 2012 Page 2 of 2 <br />1. Date of Request: the month shown is March 2012, while the application was actually submitted in <br />May. Please revise the month accordingly. <br />2. Permittee: The permittee is Western Fuels- Colorado, LLC. Please add "LLC" to this entry. <br />3. Date Permit Approved: The permit was issued on May 26, 1983, not "1981 ". Please revise. <br />4. Number of Acres: The Phase I acreage should be revised to read 100.16 acres, as given elsewhere <br />in the application. The Phase III acreage is incorrect as shown; please replace the 310.4 with 7.22, as <br />was likely intended. <br />5. Bond Company: The bank listed does not match the Division's records. Please replace with "Self <br />Bond ". <br />6. Bond Number: The bond is not a letter of credit, and the number is SB -003. Please revise. <br />7. Original Total Amount of Bond (for area requested for release): $ . Please insert this <br />line and the original dollar figure following the "Current Total Amount of Bond" and before the <br />"Dollar Amount Requested for Release" entries. <br />8. General Description of Areas for Bond Release: Please include the linear feet of roadway to the <br />north, south, and east of the intersection, and also give the county right -of -way width. <br />9. Dates Reclamation Work Performed: The second sentence states that Map R -1 shows the areas <br />that were topsoiled each year. This does not appear to be the case, and topsoiling is not relevant to <br />Phase I bond release. Please delete that sentence. The last sentence says the Phase III area was <br />reclaimed in 2005. This statement is misleading. Backfilling and grading may have been completed <br />in 2005, but the roads were gravel surfaced and opened to traffic in 2008, and asphalt paving was <br />done in 2010. Please revise this paragraph to reflect these activities. <br />10. On Page 5 of the application, the Phase III table should be revised as follows: Date of Reclamation <br />should be expanded to include the activities listed in the preceding item. The "Comments" column <br />states that the warranty period with Montrose County is complete; this contradicts the language of <br />the County's letter, provided as Page 9 of the application. Please review this comment and revise as <br />appropriate. <br />11. The Phase III section on Page 8 of the application contains a similar misrepresentation of the January <br />10, 2011 letter from Montrose County. Please revise this paragraph accordingly. <br />12. Two cross sections of the Phase I release request area have been provided on Map R -2. Given the <br />size of the area, we request that additional cross sections be generated, in the approximate locations <br />shown on the attached sketch. Please extend the sections to the east and south to include the <br />roadway alignments of 2700 Road and BB Road. <br />This concludes the Preliminary Adequacy Review for SL -13.
