(This bank is south of Dutch Creek; we were <br /> unable to determine if this pile was connected to the waste pile <br /> described in (a) above. ) The bank is steep, almost vertical, and <br /> very unstable. Rocks and dirt are eroding into the creek and <br /> trees have been uprooted and fallen down the bank, which we <br /> estimate to be at least 30 feet high. This material could <br /> partially block the creek and cause more rapid erosion into the <br /> waste pile on top. <br /> OSM should immediately inspect the site and issue imminent <br /> harm cessation orders and require immediate abatement of these <br /> conditions. In accordance with Colorado Rule 5.02(4) and 30 CFR <br /> 842. 12(d) , we request that the results of any inspection be <br /> reported to us within 10 days from the date of the inspection or, <br /> if no inspection is done, to explain to us' in writing the reasons <br /> for that decision within 15 days from the date that this letter <br /> is received-. <br /> Please note that we have mailed a copy of this report to the <br /> Colorado Division of Mining and Geology. <br /> We waive our rights to confidentiality and request the right <br /> to accompany the OSM inspector on the inspection of the mine <br /> site.
