We request on behalf of' the Crystal Valley <br /> Environmental Protection Association (CVEPA) and the Citizens <br /> Coal Council that OSH conduct an immediate inspection without <br /> -prior notice of . the Coal Basin mine located in Pitkin County near <br /> Redstone. 'Colorado. Mid Continent Resources held the mine <br /> permit. which Colorado revoked, but Pitkin Iron is now managing <br /> reclamation at the ,nine site. <br /> Our members live in the Crystal River valley and are <br /> directly affected by mining law violations at Coal Basin. We <br /> request this action because of the conditions described below <br /> which we believe are violations that cause imminent danger to <br /> public safety and imminent harm of significant environmental <br /> damage. <br /> On June 30, CVEPA President Bill Jochems, Mike Mechau , <br /> several CVLPA members , and Carolyn Johnson toured the mine site <br /> in the company of Anthony Waldron, State Inspector. We discussed <br /> sealing underground entries with him, which he said Would be done <br /> "sometime this summer ." We raised issues Nos. 2 and 3 with him; <br /> he did not take any immediate enforcement action on them. On No . <br /> 2 . he said he had issued a Notice of Violation (NOV) on an <br /> inspection some weeks ago, but he was unable co remember the <br /> exact abatement deadline; he said the deadline had not expired <br /> and the operator would repair the flume "when the Water goes <br /> down ." On No. 3, he said the State had issued an NOV on the <br /> ditch and refuse pile. We believe these three serious situations <br /> require immediate abatement. <br /> 1 . Openings .
