Renner, Coal Program Supervisor <br /> Division of Minerals and Geology <br /> Department of Natural Resources -: <br /> 215 Centennial Building <br /> 1313 Sherman Street ��� 993 <br /> Denver, Colorado 80203 �r,:;., <br /> RE: TDN-93 020 190 05 TV4 <br /> Dear Mr. Renner: <br /> The following is a written finding in accordance with 30 CFR842.11, regarding the <br /> Division of Minerals and Geology (DMG) response to the above referenced TDN. <br /> On July 7, 1993, the Albuquerque Field Office (AFO) conducted an inspection of <br /> the Coal Basin Mine in response to a citizen's complaint. As a result of this <br /> inspection, a four part TDN was issued. This TDN was sent by certified mail and <br /> received by DMG on July 12, 1993. DMG's response was received by AFO via <br /> Faxmail on July 22, 1993. <br /> Violation number 1 was issued for failure to adequately backfill an area disturbed <br /> by mining and to adequately eliminate all depressions. The area cited is the low <br /> area at the toe of the western side of the refuse disposal area above Dutch Creek. <br /> Violation number 2 was issued for failure to pass all surface drainage from a <br /> disturbed area through a sediment pond or approved drainage control. The area <br /> cited is the western side of the topsoil borrow area adjacent to the west end of the <br /> refuse disposal area. <br /> Violation number 3 was issued for failure to maintain an access road to prevent <br /> erosion and siltation. The cited area is the outslope of the road crossing the Dutch <br /> Creek Flume at the facilities area. <br />
