In addition, you also alleged that conditions
existed that constituted a significant, imminent environmental harm to land, air or water
resources. A copy of your letter had been sent to the Colorado Division of Mining and
Geology (DMG).
Both you and DMG were contacted during the afternoon of July 6, 1993, to co-ordinate an
inspection of the Coal Basin Mine for the morning of July 7, 1993. You were able to
participate in that inspection. The following are the results of that inspection relative to the
allegations contained in your letter:
1. Openings - two deep chutes located in the stacker/conveyor area.
During the inspection the DMG inspector issued a Notice of Violation (NOV)
addressing this problem. The operator immediately filled in the two holes thus
eliminating the imminent danger to the public potentially associated with those
structures. Therefore, no further action by AFO is required.
2. Dutch Creek Flume - the concrete flume conveying Dutch Creek into Coal Creek is
badly damaged.
