R <br /> Route #1 AR 81994 <br /> 3542 Front Street Pa sade, Colorado 81526 /��4���rro�' <br /> Y <br /> Dear Mr. Mechau: <br /> This is in response to your request for an informal review of the Office of Surface Mining <br /> Reclamation and Enforcement's (OSM) Albuquerque Field Office (AFO) January 5, 1994, <br /> determination on a ten-day notice (TDN) concerning Coal Basin Mine, Mid-Continent <br /> Resources, Inc. Your original complaint, dated December 3, 1993, and your request for <br /> informal review allege that the final reclamation plan for the Coal Basin Mine failed to <br /> provide for permanent closure of the haul road which would result in erosion and sediment <br /> pollution. You also were concerned that motor vehicle traffic would cause damage and be <br /> incompatible with U.S. Forest Service (USFS) post-mining land uses. <br /> In response to your complaint and the TDN, the Colorado Division of Minerals and Geology <br /> (DMG) submitted a letter dated December 22, 1993, outlining DMG's actions relating to your <br /> complaint. That letter stated that DMG had received notification that USFS wished to discuss <br /> an alternative road reclamation plan. <br /> On February 3, 1994, a public meeting was held to discuss alternative reclamation plans. <br /> A reclamation plan revision is currently being drafted by DMG and will be made available to <br /> USFS and AFO for comment. it is my understanding that AFO and DMG have agreed to <br /> share with you the revised reclamation plan when it becomes available. <br /> Accordingly, 1 affirm the AFO's determination that the DMG response to the TDN was <br /> appropriate. DMG is addressing your concern over haul road reclamation through discussions <br /> with the USFS (the landowner) regarding revisions to the reclamation plan. <br /> If you do not agree with this decision concerning your complaint, you have the right under <br /> 43 CFR §4.1281 et se . to appeal to the Office of Hearings and Appeals. If you wish to <br /> appeal this decision, your written notice must be filed within 20 days from receipt of this <br /> decision with this office and with the Office of Hearings and Appeals, Board of Land <br />
