Renner, Coal Program Supervisor <br /> Division of Minerals and Geology <br /> Department of Natural Resources <br /> 215 Centennial Building <br /> 1313 Sherman Street <br /> Denver, Colorado 80203 <br /> Dear Mr. Renner: <br /> Re: Review of Response to Ten-Day Notice #93-020-244-2, TV-1; <br /> Coal Basin Mines <br /> In accordance with 30 CFR 842.11, the following is a written finding regarding the <br /> Division of Minerals and Geology's (DMG) response to the above Ten-Day Notice <br /> (TDN): <br /> The Albuquerque Field Office (AFO) has received the Division of Minerals and <br /> Geology (DMG) response to the Ten-Day Notice (TDN) 93-020-244-2, TV-1; Coal <br /> Basin Mines (C-81-017). The response was received via phone conversation with <br /> Larry Routten on September 20, 1993, and followed with a telefax on the same <br /> day. The TDN was sent to DMG via certified mail on September 10, 1993; the <br /> AFO considers the DMG response, as received September 20, 1993, a timely <br /> response. <br /> Violation 1 of 1 of the TDN was issued in response to a citizen's complaint for the <br /> operator's failure to minimize erosion as necessary to provide protection for topsoil, <br /> vegetation, fish and wildlife, and the hydrologic balance. The area noted in the <br /> violation was the fill slopes below the mine portal benches of mines 1, 2, 3, 4 and <br /> 5. <br /> DMG responded to the TDN by issuing Notice of Violation C-93-130 to Mid- <br /> Continent Resources, Inc., for the failure to minimize erosion, using the best <br /> technology currently available so as to minimize disturbance to the prevailing <br /> hydrologic balance, topsoil and vegetation. The portion of the operation to which <br /> the notice applies, was noted as the outslopes of portal benches at mines 1, 2, 3, <br /> and 4.
