In it you stated that we would be "promptly informed <br /> of the results" of your review of the State's response to the TDN's. <br /> Furthermore, you went on to say that if a Federal inspection was necessary we <br /> would be notified in advance as far as practicable and would be given the <br /> opportunity to accompany the Federal inspector on the inspection. <br /> As we have heard nothing further from you, we are extremely interested in <br /> knowing what in fact the State's response has been and your view of its adequacy. <br /> Beyond that we respectfully request that we be given the opportunity as soon as <br /> possible to accompany the Federal inspector on site to see what actions have been <br /> taken or are being taken to address the problems. <br /> It has come to our attention that OSM inspectors have planned an inspection <br /> of the Coal Basin site next week. If so, we hereby request that CVEPA <br /> representatives be permitted to accompany them. <br /> Finally, pursuant to Sec. 517H and 521A of SMCRA, we are herewith making <br /> a new complaint, to wit, that the fill slopes below the portal benches* <br /> constitute a major on going source of active erosion disrupting the hydrologic <br /> balance, ie causing sediment-loading of the streams, that no adequate program to <br /> revegetate or otherwise stabilize these slopes has been undertaken by the <br /> operator or required by the State, and that the State has in fact represented to <br /> the operator that reclamation of these slopes need not be done in full compliance <br /> with the requirements of the applicable laws. We, therefore, request that an <br /> inspection of these areas be done by OSM and that we be notified of the time of <br /> the inspection. <br /> Thank you for your cooperation and assistance.
