NOV C-93-103 , citing the violation alleged in the TDN, was <br /> issued from this office on September 20, 1993 . A copy of the NOV <br /> is enclosed. <br /> Please note that the outslope of the Mine 5 bench is not included <br /> in this NOV, even though it is included in the TDN. The mine <br /> operator has been backfilling and grading the portal bench at this <br /> mine during the past few weeks. The site is presently under <br /> construction. All disturbed area runoff is routed to a sediment <br /> pond.
