Box 1298 <br /> Glenwood Springs, CO 81602 <br /> RE: NOV C-93-130 <br /> Dear Ms. Delaney: <br /> The Division of Minerals and Geology received Ten Day Notice X-93- <br /> 020-244-2 TV-1 from the Office of Surface Mining on September 10, <br /> 1993 . The TDN alleges a violation for failure to minimize erosion <br /> on the outslopes of the mine portal benches at the Coal Basin <br /> Mines. The TDN was issued following receipt of a citizen complaint <br /> in regard to the alleged violation. A copy of the TDN is enclosed <br /> for your records. <br /> The DMG is responding to this TDN by issuing the enclosed notice of <br /> violation (C-93-130) . While there have been a number of <br /> discussions regarding the pre or post-law status of the mine bench <br /> outslopes, the permit apparently contains no clear delineation of <br /> these areas as pre-law areas which have not been reaffected by mine <br /> operations since 1981. Consequently, this NOV which assumes Mid <br /> Continent's ongoing liability for these areas is being issued.
