As you may recall, <br /> the NOV was originally issued in response to TDN X-93-20-244-2 TV-1 <br /> from the Office of Surface Mining. As originally written, the NOV <br /> required Mid-Continent to identify and address erosion problems on <br /> the outslopes of the mine portal benches. The abatement is being <br /> modified to also address treatment of surface runoff from the <br /> outslopes. <br /> Disturbance of the outslopes has been the subject of a number <br /> discussions over the past year. The presently approved reclamation <br /> plan and abatement of NOV C-93-130 will both entail new disturbance <br /> of the outslopes. Consequently, some means of treating surface <br /> runoff for sediment control will need to be implemented.
