SETTLEMENT AGREEMENT JUSTIFICATION <br /> NOV C-93-089 <br /> Notice of Violation C-93-089 was issued for "Failure to provide <br /> adequate demonstrations to justify small area exemptions" . Dave <br /> Berry issued this NOV on June 17, 1993 to Mid-Continent Resources <br /> at the Coal Basin Mines. The portions of the operations this <br /> applied to were the Mine 4 SAE and the SAE south of Mine 1 trash <br /> dump. Representing the Division of Minerals and Geology were <br /> Tony Waldron and Larry Routten. <br /> Diane Delaney and Greg Lewicki, representing MCR, provided a <br /> demonstration for No. 4 Mine SAE. It has been an approved part <br /> of the permit. If the standards have changed she is not aware of <br /> it. There is no demonstration for the Mine 1 trash dump, <br /> although an adjacent area is covered. <br /> The proposed penalty was: <br /> History $50.00 <br /> Seriousness $250.00 <br /> Fault $250.00 <br /> Good Faith $0.00 <br /> Total $550.00 <br /> Seriousness <br /> I agree with the proposed penalty. It represents a low degree of <br /> seriousness. <br /> Fault <br /> The operator was negligent in not providing a demonstration for <br /> the Mine 1 area. It appears to be an oversight, since an <br /> adjacent area was addressed. This represents a low level of <br /> negligence. <br /> Good Faith <br /> No evidence of good faith. <br /> Settlement Agreement Penalty $550.00 <br />
