This violation was issued during an OSM inspection <br /> requested by CVEPA concerning imminent harm concerns. This open <br /> reclaim drop chute was one of their concerns and the Division <br /> decided to take an enforcement action which was abated the same day <br /> by filling in the chute with available material. An inspection <br /> report is enclosed for you review. <br /> NOV C-93-107 was issued for failure to inspect a coal waste bank on <br /> a quarterly basis. This violation discovered during the June 14-18 <br /> oversight inspection when it was noted that the old refuse pile was <br /> being inspected semi-annually not quarterly. Initially, the <br /> Division felt that there may be information available in the permit <br /> application which would clarify why the waste bank was not being <br /> inspected quarterly but none was found, therefore, the violation <br /> was issued from the office after the inspection was completed. <br /> NOV C-93-108 was issued for failure to provide ownership and <br /> controller information. This issue was also discovered during the <br /> oversight inspection and once again the Division wanted to review <br /> the information further prior to issuing an enforcement action. <br /> Upon review of the definition of owners and controllers and the <br /> information in the permit application it was determined that an NOV <br /> should be issued. <br /> The operator has not submitted any information concerning these or <br /> any violations issued as a result of the June 14-18 inspection. The <br /> inspection report has been included in file 107 for your <br /> information. <br /> If you have any questions, contact Larry Routten or me. <br />
