RE: Extension of Abatement for NOV C-93-108; Coal Basin Mine
(C-81-017)
NOV C-93-108 was issued for failure to include owner and controller
information regarding Pitkin Iron Corp in the Coal Basin permit.
MCR submitted an MR addressing the NOV which the Division received
on September 3 , 1993 . This was a timely submittal. The Division
is forwarding adequacy questions about the MR today (Oct. 14,
1993) . Because the Division is still reviewing permitting material
submitted by the operator, the abatement due date needs to be
extended more than 90 days from issuance of the NOV. This is in
accord with Rule 5. 03 .2 (2) (c) .
I recommend that the Abatement due date be extended until October
30, 1993 in order to allow the operator time to respond to the
Division' s adequacy letter. Please sign the attached extension
