Contract between MCR/ M.& E./King <br /> The contract between MCR and M. & E./King accomplishes the first major step of <br /> reclamation (i.e. removal of structures) but by its terms sets the rate and schedule of <br /> reclamation. It provides, in part: <br /> Il. SCOPE OF WORK <br /> D. Sale of Equipment. <br /> 3. Terms of Sale. Sales will be made for cash on an "as-is, where-is" <br /> basis, except as Contractor may deem appropriate . . . . <br /> 1. Removal of Structures Contractor, at Contractor's own expense, shall <br /> remove all structures located at the Mine Site, including structures located at <br /> upper portals, and located at the Load-Out Site. However, Contractor shall not <br /> be required to remove any concrete pads on which such structures are situated, <br /> or any cinder block and concrete buildings. Contractor shall use their best efforts <br /> to sell such structures as structures which can be reassembled at another <br /> location by the buyer thereof.... <br /> J. Removal of.&MO. Contractor, at Contractor's own expense, shall remove <br /> from thesM n6`Sk&and Load-Out Site, Carbondale Industrial-Park, and <br /> Carbondale F.abdcaton site, all metallic scrap, and all tires, wood-or other non- <br /> metallic scrap. If any Equipment or metal structures cannot be sold after <br /> reasonable sales efforts have been made, the same shall be considered scrap <br /> metal and may be cut up or may be given away. Scrap metal will be removed by <br /> Contractor from the sites and any proceeds derived therefrom may be retained <br /> by Contractor. Hazardous materials such as asbestos or PCBs shall be handled <br /> at Mid-Continent's expense and in accordance with govemment approved <br /> regulations. <br /> K Retention of Reclamation Eauipment Mid-Continent shall be permitted to <br /> retain one four-wheel drive pickup truck, one CAT DON Crawler Tractor, one 930 <br /> CAT loader,-one 980 CAT loader, one 945 Fiat Allis loader, one John Deere <br /> 310A backhoe loader, one CAT 16 G motor grader, one Kenworth dump truck, <br /> and one 915 E/MCO loader with bucket, the use of which may be necessary to <br /> carry out reclamation of the Mine Site. Such equipment may be retained and <br /> may be utilized by Contractor and/or for reclamation uses, at which time (but iri <br /> no event beyond three (3)years from the date of this Contract) it shall be <br /> marketed and sold by Contractor in the same manner as Mid-Continent's other <br /> equipment. <br /> L Coordination with Reclamation Activities. Contractor shall use reasonable <br /> efforts during Contractor's work at the Jobsites to coordinate Contractor's <br /> salvage activities with reclamation activities conforming to requirements of the <br /> Colorado Mined Land Reclamation Division. <br /> M. & EMng.-Salvage Contract <br />
