Box 1298 <br /> Glenwood Springs, CO 81602 <br /> RE: NOV C-93-110; File C-81-017 <br /> Dear Ms. Delaney: <br /> Enclosed is Notice of Violation C-93-110. This NOV cites a failure <br /> to pass disturbed area runoff through a sediment treatment <br /> facility. The NOV was written as a result of observations made <br /> during the joint DMG/OSM inspection on July 7 , 1993 at the topsoil <br /> borrow area adjacent to the Old Refuse Pile. <br /> As you know, a federal Ten Day Notice was issued citing this <br /> alleged violation. This office responded to the TDN by observing <br /> that the alleged violation did not exist during a follow-up <br /> inspection conducted on July 22 , 1993 . The OSM found that response <br /> to be inappropriate. Consequently, DMG is issuing the NOV today, <br /> prior to a follow-up federal inspection. Copies of all <br /> correspondence related to the above is also enclosed for your <br /> reference. <br /> Since Mid-Continent has already submitted revision materials <br /> addressing alternate treatment of runoff from the area in question <br /> and installed a gravel filter for treating the runoff, the required <br /> abatement of the violation is complete. Therefore, the NOV is also <br /> being terminated as of this date. <br />
