All three are failure to abate
cessation orders for NOV's issued earlier this year.
C-93-140 was issued on October 8, 1993 for failure to clean out
sediment ponds as required by NOV C-93-094. The CO was terminated
on November 2 , 1993 but the work was apparently done some time
before this date. November 2 was the earliest date that the mine
was inspected after the issuance of the CO.
C-93-144 and 145 were both issued on November 2, 1993 . C-93-144 was
issued for failure to abate NOV C-93-109 requiring contemporaneous
reclamation of the mine site per the schedule set forth in the May,
1991 Board Order. Of course the operator has not complied with this
schedule for a number of reasons, but the fact remains that they
are not in compliance with the schedule.
C-93-145 was issued for failure to abate C-93-108 which required
the operator to submit additional ownership and controller
information for Pitkin Iron which was the contractor on the site
performing the reclamation. Neither of these violations or CO' s
have been abated to date.
If you have any questions or require additional information, please
see me.
AJW/ajw
mcrcol
